This Terms & Conditions statement describes how your personal information is collected, used, and shared when you visit or make a purchase from www.brumate.com (the “Site”).

Personal Information We Collect

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

How Do We Use Your Personal Information?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: Communicate with you; Screen our orders for potential risk or fraud; and When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services. We share your Personal Information with third parties to help us use your Personal Information, as described above. Loyalty Program

Membership

The BrüCrew Rewards Program (“BrüCrew Rewards”) is offered by BrüMate LLC (“BrüMate”) to customers making purchases and to potential customers on BrüMate.com. BrüMate will extend certain rewards and privileges as described in more detail herein, and additional offers may be extended from time to time. These terms and conditions (“Terms and Conditions”) form the agreement (the “Agreement”) between you (“Member”) and the Company with respect to the Program.

Member acceptance of terms

By participating in BrüCrew Rewards, Member agrees to the terms and conditions, rules, regulations, policies, and procedures of BrüCrew Rewards, including, without limitation, these Terms and Conditions, including the provisions below dealing with mandatory arbitration of all disputes on an individual (i.e., non-class action) basis. Each Member is responsible for remaining knowledgeable about BrüCrew Rewards Terms and Conditions. BrüMate reserves the right to disqualify Members who have violated any of these Terms and Conditions.

BrüMate’s right to change/cancel program

BrüMate may alter, limit, modify, or terminate BrüCrew Rewards, the structure, any other feature of the BrüCrew Rewards, or these Terms and Conditions in its sole and absolute discretion at any time and in any manner without notice. Your continued participation in the BrüCrew Rewards will confirm your acceptance of such changes.

Membership eligibility

BrüCrew Rewards is limited to individuals 18+ in the U.S. and is limited to one account per individual. Membership is not available to corporations, businesses, charities, partnerships, enterprises, or anyone other than an individual unless written approval is received in advance from BrüMate in its sole and absolute discretion.

Membership enrollment

Individuals can enroll by creating an account at BrüMate.com. Members must provide information accurately and completely when creating an account. BrüMate reserves the right to refuse membership to any customer who does not follow the enrollment procedures. Members should promptly advise BrüMate of any changes to their personal account contact information, such as name and/or email address, by visiting BrüMate.com, signing in, and updating their account.

Program communications

BrüMate will use email to communicate the Member’s tier status, notify the Member of eligibility for a benefit, communicate BrüCrew Rewards changes, and more. Please note that even if you opt out of receiving marketing or promotional communications, BrüMate may continue to send you non-marketing or non-promotional emails, such as those about your account or our ongoing business relations.

Returns

Merchandise returns must be made in accordance with BrüMate’s return policy available here. Upon the return of an item, the spend and point amount applied to BrüCrew Rewards tier status for the original purchase will be deducted from the Member’s account.

Eligible purchases

Purchases of merchandise and/or services, after promotional offers have been applied before taxes and shipping charges have been applied, made at BrüMate.com count toward your Program tier status. The purchase of an eGift Card will not be applied to tier-level earnings. Additional items may be excluded from tier-level accumulation at the sole discretion of the BrüMate.

Tier status

Member tier status is based solely on a customer’s total dollar spend (after discounts, taxes and shipping) on BruMate.com. More details on BrüCrew Rewards tiers can be found here.

Referrals

Qualified Referral must:

  1. Be a natural person (i.e., no businesses, legal entities or pets) located in the 50 United States, or D.C.;

  2. Be a new / first-time BrüMate customer

  3. Make a purchase using your custom referral link or other methods supplied by us that allow for proper tracking of referrals;

  4. Consent to and comply with the General Terms and Conditions.

Referral Credits: The credit amounts change from time to time and will be set forth on our referral site (“Referral Site”). The applicable credit amounts are set to the value displayed on the Referral Site at the time the invitation was sent to the Referee to participate in the Referral Program.

Representations: By participating in the Referral Program, (i) as a Referrer, you represent and warrant that you have a personal relationship with your Referee(s) or otherwise have the necessary consents to submit their information to the Referral Program; and (ii) as a Referrer or Referee, you will comply with all applicable BrüMate policies and terms, and any and all applicable laws, rules and regulations in your participation in the Referral Program.

Restrictions: The following is a non-exhaustive list of activities that are not permitted and that will disqualify Referrers and Referees from earning through the Referral Program: (i) self-referral; (ii) making purchases on behalf of another or under an account that is not yours; (iii) creating fake accounts, blogs, web pages, profiles, websites, links or messages; (iv) any bulk distribution, submission or distribution to strangers, or any other promotion that would constitute or appear to constitute unsolicited commercial email or "spam"; (v) posting your referral link on any page that is not owned and controlled by you, including, but not limited to, any merchant, social media, or forum page; (vi) Multiple accounts created with the same name, address, email address or other identifying feature may be flagged as fraudulent referrals.

Exclusive Product

Exclusive Product offers are for a limited time, while supplies last, and provided on a first-come, first-served basis. Quantities of each Product are limited and you must be a registered BrüCrew Rewards Platinum member to redeem the Product. Customers may only redeem one Exclusive Product per transaction and cannot redeem more than 1 of any one type of Exclusive Product per year. BrüCrew Rewards Points will be deducted at the time of redemption. Exclusive Products are non-transferable, have no cash value and cannot be sold, traded, returned, or exchanged for Points, cash, another product, gift card or e-gift card. You are solely responsible for any taxes and shipping incurred by you relating to the receipt of Exclusive Product.

Valid email address

A current, valid email address is required for a Member to be eligible for select benefits, offers, and updates. Members must notify BrüMate of change of email address by updating Member account information online.

Right to revoke

BrüMate reserves the right to revoke the membership of any Member in BrüCrew Rewards and/or revoke any or all benefits the Member may be entitled to, if in the sole and absolute discretion of BrüMate, a Member abuses any BrüCrew Rewards privileges, fraudulently uses BrüCrew Rewards, fails to comply with these Terms and Conditions or otherwise earns benefits through deception, forgery and/or fraud.

No transfer

BrüCrew Rewards benefits may not be transferred, purchased, sold, assigned, auctioned, or traded, including, without limitation, by death or as part of a domestic relations matter. Doing so will void the Member account. Benefits have no cash value and are not exchangeable for cash.

Your Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Data Retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

By using our website, you (the visitor) agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your (the visitor) local currency.
